Comptroller Candidate and fully vaccinated individual, John Tabacco, was arbitrarily charged with criminal trespassing and disobeying an executive order all because he refused to wear a mask at the NYC Board of Elections Staten Island Office. He was monitoring a ballot count for the Mid-Island Council Race, at the time of his arrest.

“I am extremely pleased that the district attorney’s office made the proper decision to dismiss these charges,” said attorney Mark J. Fonte, who along with his colleague, Louis Gelormino, represented Tabacco. “Certainly, there are more pressing matters than to prosecute a fully-vaccinated individual for not wearing a mask.

“I am grateful to the district attorney for taking the time to look into this matter and resolving it in this manner.”
